Idaho Supreme Court justices are currently in Twin Falls deliberating over a challenge to a Gooding County confined-animal feeding operation ordinance.
The court heard testimony Wednesday morning from attorneys for the county, the Idaho Association of Counties and the industry groups challenging the plan, which was enacted in 2007 and meant to protect the county's groundwater, soil quality and other resources. The Idaho Dairymen's Association and Idaho Cattle Association say the ordinance strips CAFO owners of some due-process rights and regulates issues handled by state agencies. A decision will likely come within the next three months.
